A final conference is scheduled for today in the complicated legal case involving former Democratic state lawmaker Virgil Smith III of Detroit.
Smith had been charged with firing a gun at his ex-wife’s car in May of 2015.
A plea deal was worked out in which he agreed not to run for public office for the 5 years that he would be put on probation.
He was also sentenced to ten months in jail.
But last year, Smith ran unsuccessfully for a seat on the Detroit City Council.
The prosecutor tried to pull the plea deal off of the table.
A circuit court judge denied the motion.
That led to an appeal that ended up before the Michigan Supreme Court, which then ruled Smith could not be barred from running for office.
Smith was then allowed to withdraw his original guilty plea and is now going to trial, unless there is a last minute settlement..
